1. Introduction
This Cookie Policy explains how Rubysoft B.V. uses cookies and similar technologies on its websites, online store, and other publicly accessible web environments.
It supplements Rubysoft's Privacy Policy.
Rubysoft's principle is to use only cookies and similar technologies that are necessary to operate, secure, or improve the relevant web environment, or for which the visitor has given prior consent where required.
The cookies actually used may differ between web environments.
2. What are cookies?
Cookies are small data files that may be stored on or read from a visitor's device when visiting a website.
Similar technologies, such as local storage or other browser storage, may serve comparable functions. References to cookies in this Policy include such technologies where appropriate.
Cookies may be temporary and disappear when the browser is closed, or remain on the device for a specified period.
3. Rubysoft's principles
Rubysoft applies data protection by design and by default and data minimization to its use of cookies.
Rubysoft does not place non-essential cookies merely because it is technically possible to do so.
Where a purpose can be achieved without processing Personal Data, or with less data, that approach is preferred.
Rubysoft does not sell Personal Data obtained through cookies or similar technologies.
4. Strictly necessary cookies
Strictly necessary cookies are required for a website, online store, or other online service to function correctly, securely, or at the visitor's express request.
They may be used for session management, shopping-cart functionality, security, fraud prevention, authentication, remembering privacy choices, or technically processing an order.
Prior consent is generally not required for strictly necessary cookies. Rubysoft limits them to what is needed for the relevant technical purpose.
5. Preference cookies
Preference cookies may remember visitor choices such as language or display preferences.
Where they are not strictly necessary, they are used only where a valid legal basis exists and, where required, prior consent has been obtained.
Refusing non-essential preference cookies should not unnecessarily block the core functionality of the website or online store.
6. Analytics cookies
Rubysoft may use analytics cookies or similar technologies to understand how its websites and online services function technically and where improvements are possible.
Rubysoft seeks to process analytics data in a privacy-friendly manner and limit collection to what is necessary.
Where consent is required by applicable law, analytics cookies or technologies are activated only after consent.
Rubysoft does not use analytics data to create unnecessary extensive profiles of individual visitors.
7. Marketing and tracking cookies
Rubysoft uses marketing, advertising, or tracking cookies only where there is a specific purpose and this is clearly disclosed in the relevant web environment.
Where required by law, such cookies are placed only after prior consent.
Refusing marketing cookies does not affect the ability to purchase a Rubysoft License or use core website functionality.
Rubysoft does not sell Personal Data obtained through such cookies to advertisers or other third parties.
8. Third-party cookies
For certain functions, Rubysoft may use third-party services such as payment, security, hosting, video, forms, or other technical services.
Such a third party may in some cases place its own cookies or similar technologies.
When selecting and configuring such services, Rubysoft assesses what data processing is reasonably necessary and seeks to avoid unnecessary tracking.
Where a third party independently determines processing purposes, that party's privacy or cookie policy may also apply.
9. Online store and payments
The online store may use necessary cookies to remember an order, secure the session, and correctly process checkout.
Rubysoft may use an external payment service provider, which may use its own strictly necessary security or payment cookies.
Rubysoft does not receive full payment-card details where these are processed directly by the external payment provider.
Non-essential tracking may not be made a condition for completing a normal purchase unless applicable law expressly permits this.
10. Consent
Where consent is required to place or read cookies, Rubysoft obtains it before activating the relevant cookies.
Consent must be freely given, specific, informed, and expressed by an active choice.
Visitors must be able to refuse non-essential cookies without unnecessary complexity.
Consent may be withdrawn or changed at any time through the available cookie settings. Withdrawal does not affect the lawfulness of processing before withdrawal.
11. Cookie settings
Where a web environment uses non-essential cookies, Rubysoft provides a means to manage cookie preferences.
Visitors may also delete or block cookies through browser settings.
Blocking necessary cookies may prevent parts of a website, online store, or online service from functioning correctly.
Browser cookie-management methods vary by browser and device.
12. Retention periods
Cookies are not retained longer than necessary for their purpose.
The specific retention period may differ per cookie and, where relevant and technically available, will be stated in the cookie settings or cookie overview for the relevant web environment.
Session cookies are generally deleted when the browser session ends.
Rubysoft periodically reviews whether cookies remain necessary and removes or replaces cookies that no longer serve an appropriate purpose.
13. Personal Data
Where cookies process Personal Data, Rubysoft's Privacy Policy applies.
Depending on the technology, processing may include an online identifier, session data, technical browser information, cookie preferences, or limited usage information.
Rubysoft limits processing to what is necessary for the relevant purpose.
For rights relating to Personal Data, including access, correction, erasure, and objection, please refer to the Privacy Policy.
14. International transfers
Where a cookie or web-service provider processes Personal Data outside the European Economic Area, Rubysoft will, to the extent it is responsible, ensure that a valid transfer mechanism and appropriate safeguards are in place.
Further rules are described in Rubysoft's Privacy Policy.
15. Current cookie overview
The exact cookies used in a web environment may change when Rubysoft changes its website, online store, hosting, security, or other technical facilities.
Where non-essential cookies are used, the current cookie overview in the relevant web environment should identify the cookies or categories used, their purpose, the party placing them, and their duration.
The technical cookie inventory of the live web environment is authoritative for the concrete list of cookies actually used.
Rubysoft will not present a cookie in this Policy as actually used where this is not supported by the technical configuration of the relevant web environment.
16. Changes
Rubysoft may amend this Cookie Policy when its websites, online store, technology, or applicable law changes.
The most recent version will be made available on Rubysoft's website.
Where a change affects previously given consent, Rubysoft will obtain renewed consent where required.
