1. Purpose and applicability

  1. This Acceptable Use Policy describes permitted and prohibited use of Rubysoft Software, Licenses, accounts, and Online Services.

  2. It applies to every Customer and User of Rubysoft products or services and supplements the General Terms of Delivery and License and, where applicable, other agreements. Specific written agreements prevail in the event of a conflict.

2. General principle

  1. Rubysoft expects its products and services to be used for lawful and professional purposes and in accordance with the agreed License.

  2. The Customer is responsible for use by persons to whom it grants access. A technically possible action is not automatically permitted if it violates the Agreement, this Policy, or applicable law.

3. Lawful use

  1. The Software and Services may be used only for lawful purposes.

  2. They may not be used for fraud, deception, infringement of third-party rights, or other unlawful activities, and Users must not process or distribute data, files, or instructions through Rubysoft systems that they know or reasonably should know are unlawful.

  3. The Customer remains responsible for the lawfulness of data and designs processed with the Software.

4. Licenses and accounts

  1. Licenses and accounts may be used only by the persons and organizations for whom they are intended under the Agreement.

  2. Licenses, activation data, accounts, or credentials may not be sold, rented, shared, loaned, resupplied, or otherwise made available to unauthorized third parties.

  3. Technical License or account restrictions may not be circumvented, manipulated, or disabled. The Customer must take reasonable measures against unauthorized use and promptly report suspected misuse.

5. Protection of the Software

  1. Security measures, License checks, technical restrictions, copyright notices, and other protection mechanisms may not be removed, modified, or circumvented.

  2. Reverse engineering, decompilation, disassembly, or other analysis intended to discover source code, internal algorithms, or non-public technical operation is prohibited except to the extent expressly permitted by mandatory law.

  3. The Software or substantial parts may not be copied or used to develop a competing product or functional reproduction.

  4. Public benchmark, performance, or comparative testing may be published only with Rubysoft's prior written consent to the extent such a restriction is legally permitted.

6. Artificial intelligence and automated analysis

  1. Without Rubysoft's prior written consent, the Software, source code, object code, Documentation, or substantial portions may not be used as training material for artificial-intelligence or machine-learning models.

  2. Automated techniques may not be used to systematically analyze the Software's operation, structure, or functionality for the purpose of reproduction or developing a competing product.

  3. This does not restrict ordinary use of general AI tools for a Customer's own work, provided protected Rubysoft materials are not disclosed to third parties or external systems in violation of the Agreement.

7. Security

  1. Users may not attempt unauthorized access to Rubysoft systems, accounts, License Servers, Support Environments, or infrastructure.

  2. Users may not deliberately exploit vulnerabilities, distribute malware, bypass security controls, or unnecessarily burden Rubysoft systems.

  3. Potential vulnerabilities should be reported confidentially to support@rubysoft.eu. Security research must not access other customers' data, damage systems, disrupt services, or destroy or alter data.

8. Online Services and Support Environment

  1. Online Services and the Support Environment may be used only for their intended purpose.

  2. Users may not upload malicious files or malware or generate automated traffic or data volumes that are unreasonable for normal use.

  3. Project files submitted for support may contain only data the Customer is lawfully entitled to provide.

  4. Rubysoft may implement technical measures to prevent misuse, security risks, or disproportionate load.

9. API use

  1. If Rubysoft provides API functionality, it may be used only in accordance with the applicable API Terms, Documentation, and technical restrictions.

  2. API security, access restrictions, rate limits, and other technical measures may not be circumvented. API keys and credentials must be kept confidential.

  3. Rubysoft may limit or temporarily block API access where use creates a security risk, seriously disrupts services, or demonstrably violates the applicable terms.

10. Intellectual property and third-party data

  1. Users must respect intellectual property rights, trade secrets, privacy rights, and other third-party rights.

  2. The Customer warrants that it is entitled to use data, models, drawings, images, and other materials processed through Rubysoft systems or provided to Rubysoft.

  3. Normal use of Rubysoft Software does not transfer ownership of Customer project data or designs to Rubysoft.

11. Sanctions and export restrictions

  1. The Software and Services may not be used, supplied, resupplied, or made available in violation of applicable sanctions, export-control, or trade laws.

  2. The Customer must not make the Software available to prohibited persons, organizations, countries, or territories.

  3. Rubysoft may refuse, suspend, or terminate access where continuation would reasonably violate applicable sanctions or export laws.

12. Investigation of suspected misuse

  1. Rubysoft may investigate where it has reasonable grounds to suspect a violation of this Policy.

  2. Any investigation will be limited to what is reasonably necessary to establish or stop the suspected misuse or prevent harm, taking into account privacy, confidentiality, and Customer business continuity where possible.

  3. The Customer must provide reasonable cooperation where necessary to investigate a specific suspicion.

13. Measures in case of violation

  1. Depending on the nature and severity of a violation, Rubysoft may warn the User, require corrective action, restrict or temporarily suspend specific access, or take other reasonable protective measures.

  2. Where reasonably possible, Rubysoft will first allow an opportunity to remedy the violation unless immediate action is required because of fraud, a serious security risk, a legal obligation, or another compelling reason.

  3. Termination of a License or Agreement is governed by the General Terms and applicable law. Measures will not go beyond what is reasonably necessary to end the violation or risk.

14. No general monitoring obligation

  1. This Policy does not require Rubysoft to continuously or generally monitor use of its Software or Services.

  2. Rubysoft may apply technical controls where necessary for License management, security, protection of infrastructure, or compliance with legal obligations, and will not process more data than reasonably necessary for that purpose.

15. Changes

  1. Rubysoft may amend this Policy in response to new forms of misuse, technical developments, security risks, or changes in law.

  2. The current version will be made available through the website or electronically. Changes do not retroactively restrict existing contractual rights unless legally permitted or agreed.
